If you consider all the parameters of the universe to be too arbitrary to be a coincidence then this would lead you to believe that there is in fact a God, then you can incorporate this into your argument. The tree makes a sound because God is the ultimate observer. But this is a very weak argument. But, the conservation of energy, that makes this argument quite solid. The energy of the falling tree has to be conserved and in doing so, some of the energy is converted into sound. The falling tree creates waves in the air, a physical phenomenon that actually takes place; it has to take place, regardless if there is an observer present. These waves exist even if there is nobody around to witness it. If there was a deaf guy wondering through the forest, and a tree fell. There was still nobody around to hear it, does your argument still hold true? That what this man had witnessed despite his disability was in fact a silent act.
